Terms and Conditions
The terms that apply to your membership at Kraftwerk Heerlen.
1. Applicability
1.1 By entering into a membership with Kraftwerk Heerlen, the customer agrees to the terms set out below. These terms apply to all agreements between Kraftwerk Heerlen and the member. Use of Kraftwerk Heerlen's facilities is not permitted without acceptance of these terms.
1.2 Kraftwerk Heerlen reserves the right to change these Terms. If changes materially affect the core of the agreement (including price and duration), the member has the right to cancel the membership on the date the change takes effect.
1.3 Changes are announced at least 4 weeks in advance. The most current terms can be viewed at any time on our website www.kraftwerkheerlen.nl.
2. General
2.1 Contracting party: After signing the membership agreement (the agreement), the named person becomes a member of Fitnessclub Kraftwerk Heerlen B.V. (Kraftwerk Heerlen).
2.2 Services: After payment, the member may use the agreed services during opening hours.
2.3 Minors: Membership for persons under 18 requires written consent from a parent/guardian. Membership is not available for children under 16.
2.4 Right of withdrawal: Online registration comes with a statutory 14-day cooling-off period. Within this period the member can cancel the agreement without giving a reason. See our Right of Withdrawal page for the full procedure.
3. Access to and use of Kraftwerk Heerlen
3.1 Access: Members get access to Kraftwerk Heerlen via a personal access tag or the QR code in the VirtuaGym app. Without a valid tag or QR code, access is not possible.
3.2 House rules: Members must follow the house rules and any staff instructions. Violations may lead to exclusion.
3.3 Lockers: Kraftwerk Heerlen is not liable for loss or theft from lockers. Valuables should be stored in a locked locker.
3.4 Parking: Members can park free at Interparking Maankwartier Centrum for up to 3 hours. The external parking operator's further rules apply.
3.5 Opening hours: Kraftwerk Heerlen may close and/or cancel group classes on public holidays, school breaks or in case of force majeure, without refunding membership fees.
4. Member obligations
4.1 Access tag: Loss or damage of the access tag must be reported immediately at reception. A replacement tag costs €10.
4.2 Non-transferability: The membership and access tag are strictly personal and non-transferable. A €150 fine may be imposed for violations and the membership can be terminated immediately.
4.3 Tag return: On termination of membership the access tag must be returned. €10 is charged if not returned.
4.4 Changes: Changes to personal details (address, email, bank account number) must be reported to Kraftwerk Heerlen immediately.
5. Membership fees and payments
5.1 Monthly payments: Payments are made monthly in advance via direct debit and are due per calendar month.
5.2 Pro-rata costs: If the membership does not start on the first of the month, costs for the remaining days of that month are charged pro rata.
5.3 Reversal fees: In case of insufficient balance or a reversed direct debit, additional costs may be charged, including €10 administration fees.
5.4 Default: If payment is more than 30 days overdue, access may be denied. The payment obligation remains. With continued default, the membership may be terminated and the claim transferred to a debt collection agency, with additional costs at the member's expense.
5.5 Additional costs: Additional services, such as personal training, are billed separately.
5.6 Indexation: Kraftwerk Heerlen may index the membership fee annually in line with the Dutch Consumer Price Index (CPI) from CBS. If an increase exceeds the CPI percentage, the member has the right to cancel the membership on the date the increase takes effect.
6. Memberships, duration and termination
6.1 Kraftwerk Heerlen offers the following memberships:
Flexible membership — 1 month
Cancel monthly with a notice period of 1 calendar month.
Quarterly membership — 3 months
Initial duration of 3 months. After this period the membership is tacitly extended monthly. Cancellable with a notice period of 1 calendar month.
Student membership — 6 months
Initial duration of 6 months, only for full-time students. After this period the membership is tacitly extended monthly. Cancellable with a notice period of 1 calendar month.
Standard membership — 12 months
Initial duration of 12 months. After this period the membership is tacitly extended monthly. Cancellable with a notice period of 1 calendar month.
6.2 Cancellation must be made in writing at least 1 calendar month before the desired end date via the cancellation form (online, by email or at the front desk). Once processed, the member receives confirmation by email. The end date in that confirmation is binding.
6.3 Early cancellation of the initial contract period is not possible, except in the exceptions mentioned in article 7.
6.4 During the membership term, the obligation to pay the monthly fee continues, even if the facilities are not used.
7. Pausing the membership
7.1 Pause: In case of prolonged illness, injury or pregnancy the membership can be paused on request for a minimum of 1 month and a maximum of 2 months per calendar year. A medical certificate from a GP is required.
7.2 Relocation: When moving to an address more than 20 km from Kraftwerk Heerlen, the membership can be terminated early with a 1-month notice. Proof of relocation (municipal registration at the new address) is required.
7.3 During the pause, no membership fee is due. The end date of the contract is extended by the length of the pause.
8. Hygiene and clothing
8.1 Towel rule: Using a towel on all equipment and machines is mandatory.
8.2 Cleaning equipment: Members must clean equipment after use with the cleaning products provided.
8.3 Sportswear: Wearing appropriate, clean sportswear is mandatory. Jeans, street clothes, flip-flops and open shoes are not allowed on the training floor.
8.4 Sports shoes: Clean (indoor) sports shoes are mandatory. Shoes worn outdoors or leaving black marks are not allowed.
8.5 Bags and personal items: Sports bags and jackets must be stored in lockers and are not allowed on the training floor.
8.6 Breaching hygiene rules may result in a warning. Repeated breaches can lead to access being denied.
9. Behaviour in our fitness club
9.1 Prohibited substances: Smoking, alcohol, drugs or performance-enhancing substances are prohibited inside Kraftwerk Heerlen. Violations can lead to immediate termination of the membership.
9.2 Respectful behaviour: Members must behave respectfully towards other members, visitors and staff. Unwanted behaviour, including intimidation, discrimination or aggression, can lead to immediate exclusion.
9.3 Social media: Taking photos or videos of other members without their explicit consent is not allowed. This is to protect the privacy of everyone present.
10. Liability
10.1 Own risk: Using the facilities and participating in activities at Kraftwerk Heerlen is at the member's own risk.
10.2 Limitation of liability: Kraftwerk Heerlen is not liable for damage to or loss of personal property, nor for injury sustained during use of the facilities, unless due to intent or gross negligence by Kraftwerk Heerlen or its staff.
10.3 Duty of care: Kraftwerk Heerlen ensures proper maintenance of the equipment and facilities and provides sufficiently qualified staff.
10.4 Dutch law applies to all agreements.
11. Force majeure
11.1 Kraftwerk Heerlen is not obliged to fulfil any obligation if prevented from doing so due to force majeure. This includes: epidemics, natural disasters, strikes, government measures and force majeure at third parties on whom Kraftwerk Heerlen depends.
11.2 In case of closure or restricted facilities due to force majeure, Kraftwerk Heerlen is not obliged to refund or compensate. If closure lasts more than 4 consecutive weeks, the member has the right to pause the membership free of charge for the duration of the closure.
12. Privacy
12.1 Kraftwerk Heerlen processes personal data in accordance with the General Data Protection Regulation (GDPR). The full privacy statement is available at www.kraftwerkheerlen.nl/privacy.
12.2 The member has the right at any time to view, correct and delete their own personal data, in line with the rights under the GDPR.
13. Additional provisions
13.1 Booking system: Certain group classes and facilities use a booking system via the VirtuaGym app. Rules on cancellations, no-shows and availability are on the website and in the app.
13.2 Pets policy: Pets are not allowed inside the facility, with the exception of officially recognised service and guide dogs.
13.3 Intellectual property: Use of brands, logos or copyrighted materials from Kraftwerk Heerlen without prior written consent is not allowed.
13.4 Complaints: Members can submit complaints at reception or by email to info@kraftwerk-heerlen.nl. Kraftwerk Heerlen aims to resolve complaints within 14 days.
13.5 Changes to facilities: Kraftwerk Heerlen reserves the right to change the offer of facilities, group classes and opening hours.
