Terms and Conditions

1.1 By entering into a membership with Kraftwerk Heerlen, the customer agrees to the terms set out below. These terms apply to all agreements between Kraftwerk Heerlen and the member. Use of Kraftwerk Heerlen's facilities is not permitted without acceptance of these terms.

1.2 Kraftwerk Heerlen reserves the right to change these Terms. If changes materially affect the core of the agreement (including price and duration), the member has the right to cancel the membership on the date the change takes effect.

1.3 Changes are announced at least 4 weeks in advance. The most up-to-date terms can always be viewed on our website www.kraftwerkheerlen.nl.

2.1 Contracting party: After signing the membership agreement (hereinafter: the agreement), the named person becomes a member of Fitnessclub Kraftwerk Heerlen B.V. (hereinafter: Kraftwerk Heerlen).

2.2 Services: After payment, the member may use the agreed services during opening hours.

2.3 Minors: Membership for persons under 18 requires written permission from a parent/guardian. Membership is not available for children under 16.

2.4 Right of withdrawal: For online registrations, a statutory cooling-off period of 14 days applies. Within this period, the member may terminate the agreement without giving any reason. See our Right of Withdrawal page for the full procedure.

3.1 Access: The member gains access to Kraftwerk Heerlen using a personal access tag or via the QR code in the VirtuaGym app. Access to facilities is not possible without a valid tag or QR code.

3.2 House rules: Members must adhere to the house rules and any instructions from staff. Breaches may lead to exclusion.

3.3 Lockers: Kraftwerk Heerlen is not liable for loss or theft from lockers. Valuables must be stored in a locked locker.

3.4 Parking: Members can park free at Interparking Maankwartier Centrum for up to 3 hours. Further rules of the external parking operator apply.

3.5 Opening hours: Kraftwerk Heerlen may close and/or cancel group classes on public holidays, during school holidays or in cases of force majeure, without refund of membership fees.

4.1 Access tag: Loss or damage to the access tag must be reported to reception immediately. A replacement tag costs €10.

4.2 Non-transferability: The membership and access tag are strictly personal and non-transferable. A breach may incur a €150 fine and immediate termination of the membership.

4.3 Returning the tag: Upon termination of membership, the access tag must be returned. Failure to do so incurs a €10 charge.

4.4 Changes: Changes to personal details (address, email, bank account number) must be communicated to Kraftwerk Heerlen immediately.

5.1 Monthly payments: Payments are made monthly in advance via direct debit and must be paid per calendar month.

5.2 Pro-rata charges: If the membership does not start on the first of the month, the costs for the remaining days of that month are calculated and charged pro-rata.

5.3 Chargeback costs: Insufficient balance or chargebacks may result in additional charges, including €10 in administrative fees.

5.4 Default: In case of overdue payments exceeding 30 days, access may be denied. The payment obligation remains. Persistent default may result in membership termination and referral to a collection agency, with collection costs borne by the member.

5.5 Additional costs: Additional services, such as personal training, are invoiced separately.

5.6 Indexation: Kraftwerk Heerlen may adjust membership fees annually in line with Statistics Netherlands (CBS) Consumer Price Index (CPI). If an increase exceeds the CPI percentage, the member has the right to cancel the membership on the date the increase takes effect.

6.1 Kraftwerk Heerlen offers the following memberships:

6.2 Cancellation must be made in writing at least 1 calendar month before the desired end date via the cancellation form (online, by email or at the front desk). Once processed, the member receives confirmation by email. The end date in that confirmation is binding.

6.3 Early cancellation of the initial contract period is not possible, except in the exceptions mentioned in article 7.

6.4 During the membership term, the obligation to pay the monthly fee continues, even if the facilities are not used. Non-use or reduced use of the facilities, for any reason whatsoever (including illness outside the conditions of article 7, vacation, lack of time or personal circumstances), shall never entitle the member to any refund, reclamation, suspension or reduction of membership fees.

6.5 Remaining visits on class passes, session passes or other credits and balances are strictly personal, non-exchangeable for cash, and will not be refunded upon expiration of their validity or upon termination of the membership.

7.1 Pause: In case of prolonged illness, injury or pregnancy the membership can be paused on request for a minimum of 1 month and a maximum of 2 months per calendar year. A medical certificate from a GP is required.

7.2 Relocation: When moving to an address more than 20 km from Kraftwerk Heerlen, the membership can be terminated early with a 1-month notice. Proof of relocation (municipal registration at the new address) is required.

7.3 During the pause, no membership fee is due. The end date of the contract is extended by the length of the pause.

8.1 Towel rule: Using a towel on all equipment and machines is mandatory.

8.2 Cleaning equipment: Members must clean equipment after use with the cleaning products provided.

8.3 Sportswear: Wearing appropriate, clean sportswear is mandatory. Jeans, street clothes, flip-flops and open shoes are not allowed on the training floor.

8.4 Sports shoes: Clean (indoor) sports shoes are mandatory. Shoes worn outdoors or leaving black marks are not allowed.

8.5 Bags and personal items: Sports bags and jackets must be stored in lockers and are not allowed on the training floor.

8.6 Breaching hygiene rules may result in a warning. Repeated breaches can lead to access being denied.

9.1 Respectful conduct: Members and visitors must behave respectfully towards employees, other members and other persons present, and must follow all reasonable instructions from staff regarding order and safety at all times.

9.2 Zero tolerance for aggression: Aggression, threats, intimidation, physical or verbal violence, vandalism, discrimination, severe insults and any other serious boundary-crossing behavior will never be tolerated.

9.3 Measures and sanctions: Depending on the nature and severity of a violation, Kraftwerk Heerlen may address or warn the member, temporarily suspend access, or terminate the membership if the violation is sufficiently serious.

9.4 Immediate denial of access and termination: In the event of serious aggression, threats, violence or other severe misconduct, Kraftwerk Heerlen may immediately deny the member access to the facility. If the behavior constitutes a sufficiently serious breach of contract, Kraftwerk Heerlen may terminate the agreement with immediate effect. No prior warning is required if the nature or severity of the conduct justifies immediate intervention.

9.5 Police report: Kraftwerk Heerlen reserves the right to report or file a complaint with the police in the event of suspected criminal offenses, threats, violence, property damage or other serious incidents.

9.6 No refund upon termination for misconduct: A definitive termination will be confirmed to the member in writing. In the event of denial of access or termination of the agreement due to serious misconduct, aggression or breach of these terms and house rules, no refund will be provided for membership fees or dues already paid for the current billing period. Furthermore, the payment obligation for the agreed contract term remains in full force, without prejudice to Kraftwerk Heerlen's right to claim full compensation for any damages suffered.

9.7 Prohibited substances: Smoking, alcohol, drugs or performance-enhancing substances are strictly prohibited inside the facilities of Kraftwerk Heerlen. Violations may lead to immediate termination of the membership.

9.8 Privacy, photo and video: Taking photos or videos of other members without their explicit prior consent is not permitted, in order to protect the privacy of all visitors.

9.9 Phone calls: To prevent nuisance and distraction for other members, making phone calls on the gym floor and in the group class studios is not permitted. Phone calls may only be conducted in the changing rooms or outside the training floor (such as in the cafe or reception area).

10.1 Own risk: Using the facilities and participating in activities at Kraftwerk Heerlen is at the member's own risk.

10.2 Limitation of liability: Kraftwerk Heerlen is not liable for damage to or loss of personal property, nor for injury sustained during use of the facilities, unless due to intent or gross negligence by Kraftwerk Heerlen or its staff.

10.3 Duty of care: Kraftwerk Heerlen ensures proper maintenance of the equipment and facilities and provides sufficiently qualified staff.

10.4 Dutch law applies to all agreements.

11.1 Kraftwerk Heerlen is not obliged to fulfil any obligation if prevented from doing so due to force majeure. This includes: epidemics, natural disasters, strikes, government measures and force majeure at third parties on whom Kraftwerk Heerlen depends.

11.2 In case of closure or restricted facilities due to force majeure, Kraftwerk Heerlen is not obliged to refund or compensate. If closure lasts more than 4 consecutive weeks, the member has the right to pause the membership free of charge for the duration of the closure.

12.1 Kraftwerk Heerlen processes personal data in accordance with the General Data Protection Regulation (GDPR). The full privacy statement is available at www.kraftwerkheerlen.nl/privacy.

12.2 The member has the right at any time to view, correct and delete their own personal data, in line with the rights under the GDPR.

13.1 Booking system: Certain group classes and facilities use a booking system via the VirtuaGym app. Rules on cancellations, no-shows and availability are on the website and in the app.

13.2 Pets policy: Pets are not allowed inside the facility, with the exception of officially recognised service and guide dogs.

13.3 Intellectual property: Use of brands, logos or copyrighted materials from Kraftwerk Heerlen without prior written consent is not allowed.

13.4 Complaints: Members can submit complaints at reception or by email to info@kraftwerk-heerlen.nl. Kraftwerk Heerlen aims to resolve complaints within 14 days.

13.5 Changes to facilities: Kraftwerk Heerlen reserves the right to change the offer of facilities, group classes and opening hours.

14.1 Offering: In addition to the agreed components of the membership, Kraftwerk Heerlen may offer additional services, products, refreshments, promotions, discounts and other member benefits. These may be provided free of charge, at a reduced member rate, or against payment.

14.2 Examples: Examples of these include, among others, discounted or complimentary coffee, tea, other beverages, products, promotional campaigns and similar extra amenities.

14.3 No part of core agreement: An additional service, product, refreshment, promotion or member benefit only forms part of the agreed performance of the membership if it was explicitly agreed upon in writing at the conclusion of the agreement as an included component of the respective membership.

14.4 Right to modify: Amenities provided voluntarily, temporarily or as an extra member service that do not form an agreed component of the membership may be modified, restricted, replaced or discontinued by Kraftwerk Heerlen at any time. A complimentary extra may also be converted into a paid product or a product subject to a special member rate or member discount.

14.5 No refund or cancellation rights: The modification or discontinuation of such an additional service does not entitle the member to any price reduction, refund or early termination of the membership, insofar as the respective service does not form an agreed component of the membership and the statutory rights of the member do not oppose this.

14.6 Explicitly agreed services: If an additional service was explicitly agreed upon as an included component of the membership, any modification thereof will be assessed in accordance with the agreement, these general terms and conditions, and applicable statutory provisions.
